It begins where trust creation ends, and it falls to the successor trustee named in the trust document. For many families, that trustee is a spouse, an adult child, or a sibling with no prior legal or financial background, stepping into a role that carries real legal responsibility.

Without guidance, trustees can face personal liability for errors in asset management, missed tax filings, or distributions that don’t align with the trust’s terms. Trustee Duties Under the Arkansas Trust Code

Arkansas has adopted the Uniform Trust Code, codified at Ark. Code Ann. Title 28, Chapter 73. Known as the Arkansas Trust Code, it governs how trustees must manage trusts, what beneficiaries are entitled to know, and what happens when those obligations aren’t met.

When you accept a trusteeship in Arkansas, you take on a set of fiduciary duties, meaning legal obligations to act in the interests of the beneficiaries rather than your own:

Duty of loyalty: Act solely in the interests of the beneficiaries, not your own
Duty of prudent administration: Manage trust assets with the care a reasonably prudent person would use
Duty of impartiality: Balance the interests of all beneficiaries fairly, including those with current distributions and those with future interests
Duty to inform and report: Keep beneficiaries informed of the trust’s status and provide annual accountings

Arkansas law also sets specific deadlines. A trustee must notify qualified beneficiaries within 60 days of accepting the trusteeship, and again within 60 days of learning that a formerly revocable trust has become irrevocable, whether by the grantor’s death or otherwise. Annual reports detailing the trust’s property, liabilities, receipts, and disbursements are required on an ongoing basis.

The Core Steps of Trust Administration

The full administration process generally involves gathering and inventorying all trust assets; notifying beneficiaries; paying valid debts and creditor claims; filing required tax returns, including any final income tax return for the grantor; managing assets during the administration period; and distributing property to beneficiaries according to the trust’s terms. Arkansas doesn’t impose a state estate tax or inheritance tax, so only the federal estate tax applies, and only to estates that exceed the federal exemption threshold. How long the process takes depends on asset complexity, the number of beneficiaries, whether creditor claims arise, and whether any disputes need resolution.

Many Arkansans create trusts as part of a broader Medicaid planning and long-term care strategy. An irrevocable trust used to shelter assets from Medicaid spend-down requirements carries specific administration obligations when the grantor dies or becomes incapacitated. A general-practice attorney may not recognize those obligations, and a misstep can affect the family’s planning strategy or trigger a Medicaid estate recovery claim against the trust.

Trust Administration vs. Probate in Arkansas

Probate is a court-supervised process used to settle an estate when assets are titled in the decedent’s name alone and no beneficiary designation or trust controls their transfer. Trust administration, by contrast, is generally handled outside of probate court, which is why many Arkansans create revocable living trusts in the first place. Probate can last months or longer and involves court filings and public records. A properly funded trust can allow a successor trustee to settle the estate privately and potentially on a faster timeline.

That said, not every asset follows the trust automatically. Property that was never retitled into the trust, or that lacks a beneficiary designation, may still require probate even when a trust exists. The two processes can run in parallel depending on how the grantor’s assets were owned and titled.

There’s also an important distinction when the grantor becomes incapacitated rather than dying. A will only takes effect at death, so it offers no help when someone loses capacity. A revocable living trust, however, can allow a named successor trustee to step in and manage assets immediately, without court involvement. Whether an estate requires probate, trust administration, or both depends on a careful review of all assets, which is why that review is the first step in our process.
